Cour des Marchés - Market Court

Un recours peut être introduit devant la Cour des marchés (section bilingue de la cour d’appel de Bruxelles) contre les décisions des autorités administratives et des régulateurs dans le domaine de l’économie, des finances et des marchés. Il s’agit d’un recours en un seul degré de (pleine) juridiction.

La Cour des marchés offre aux parties un recours effectif contre la plupart des décisions des régulateurs sensu lato, comme le garantit l'article 47 de la CDFUE.

Decisions taken by regulators and administrative authorities in the field of economic, financial and market law can be subject to a "one instance" jurisdictional appeal (the Market court having full jurisdiction) before the Market Court (a bilingual section of the court of appeal) in Brussels.

The Market Court grants the applicants an effective remedy and a fair trial before a tribunal against most decisions of regulatory authorities in the broad sense of the term as guaranteed by Article 47 of the EU Charter of Fundamental Rights.
